PRIVACY POLICY INFORMATION NOTICE REGULATION (EU) 2016/679
Pursuant to 2016/679 EU Regulation, MOTOCROSS MARKETING s.r.l., as Data Controller, informs you that your personal data will be processed fairly, lawfully and in a transparent manner, protecting your privacy and your rights in accordance with the Company’s privacy policy.
MOTOCROSS MARKETING s.r.l. also undertakes to process your data in compliance with the principle of "minimisation", that is processing the data limited to what is necessary in relation to the purposes for which they are processed.
Purposes
The processing of personal data necessary for the performance of a contract, regulations, fiscal and accounting obligations, as well as for your specific requests, in addition to provide commercial information about our products and services, will be at MOTOCROSS MARKETING s.r.l. by use of procedures including computerized procedures, in the ways and within the limits necessary to pursue the aforementioned purposes.
Particularly, purposes will be:
a) provide the data, for the conclusion of sales contracts, to comply with them and to prevent creditor positions (execution of the contract between the parties);
b) for operational, management, administrative and accounting purposes, including sending of commercial invoices by electronic mail (in compliance with legal obligations, particularly in taxation);
c) allow the access and browsing of the website, process anonymous statistics on their use, check their operation and ascertain any liability in the event of illegal conducts (legitimate interest of the Data Controller);
d) carry out marketing, commercial information and promotional activities, also based on profiling, including sending newsletters and advertising material also through messaging applications. Profiling activities that will be carried out will be based on the analysis of the browsing and purchasing behaviour and will be used for behavioural advertising purpose (with explicit consent).
The provision of data for contractual purposes referred points a), b) and c) is mandatory (in absence, it is not possible to perform the sales contract and to provide related services).
For marketing purposes point d) you will be required to give your consent, without prejudice to the right of withdraw at any time (without prejudice to the lawfulness of the previous processing).
Data communication - Data transfer
The personal data collected may be communicated, as far as their specific competence, to public administrations to perform institutional functions, to banking institutions, to subjects specialized in management of information systems and/or payment systems, to subjects that provide goods and services offered by the Data Controller, to subjects that carry out transport or shipping activities, to subjects that MOTOCROSS MARKETING srl uses to carry out promotional, advertising, marketing and communication activities, law firms and consulting firms, persons in charge of accounting or auditing financial statements of the company, public authorities for the fulfillment of the law, internal staff of the company previously appointed.
In any case, personal data will not be disseminated.
Where strictly necessary for the performance of a contract, your personal data may be disclosed to third parties, such as, for example, suppliers of products and/or services, located both within and outside the E.U.. Any transfer outside the EU is regulated by special contracts in order to require the recipient of the data to apply appropriate guarantees provided for by current legislation.
General
All personal data processed by MOTOCROSS MARKETING srl are protected by adequate security measures, as required by the current legislation and for the time strictly necessary to meet the purposes.
The criterion used to determine the retention period of personal data is:
For purposes referred points a) and b) your data will be stored for the period provided by the law.
For purposes referred point c) data will be stored for 5 years.
For purposes referred point d) data will be stored until the withdrawal of consent or the termination of the relationship.
As provided by art. 13 and 15 GDPR (EU) 2016/679, we remind you that you have the right to request MOTOCROSS MARKETING srl the access to your personal data, their rectification, cancellation (where applicable) or limitation of processing. You also have the right to revoke your consent to processing for which you have given your consent, as well as the right to lodge a complaint with the Personal Data Protection Authority www.garanteprivacy.it
